Dessange USA, Inc. (“Dessange,” “we” or “our”) (i) owns and operates the Dessange business, and (ii) may franchise independently owned and operated Dessange salons (“Franchised Salon(s)”) the right to use the Dessange system and trademarks.

The purpose of this Privacy Policy is to explain our practices in connection with our https://kingsidepartners.com website (including any mobile optimized versions of our site) (the “Website”), any software applications made available by us for use on or through computer and mobile devices (the “App(s)”), and any social media pages that we may control (collectively, the “Services”). By using the Services, you are agreeing to this Privacy Policy and all of the terms and conditions contained herein. If you do not agree with this Privacy Policy, please do not use the Services or provide us with any of your Personal Information (defined below). Please also visit our Terms and Conditions section establishing the use, disclaimers, and limitations of liability governing the use of the Services.

 

This Privacy Policy does not apply to Franchised Salons, which are owned and operated by independent business people. For example, a Franchised Salon may use email, texting or other methods of communicating with its guests. Each Franchised Salon is solely responsible for those types of communication, and you should contact a Franchised Salon directly to understand how it may treat your personal information.

We may collect personal information about you (information that identifies you as a specific person or relates to you as a specific person) (“Personal Information” or “PI”). Some examples of data we collect include the following:

This type of information may not identify the individual user, but instead may identify the computer or other device used. Additionally, Personal Information once de-identified is not subject to this Privacy Policy and we may treat it as non-Personal Information and use it without obligation to you except as may be prohibited by law.

This type of information may be used to locate your proximity to nearby Dessange salons, or to identify offers and other location specific items that may be of interest to you.

 

How is the Personal Information that We Collect Used?
The Personal Information that we may collect from you may be used for our legitimate interests, including:

 

  • To send you marketing communications
  • For our business purposes (marketing research, data analysis, etc.)
  • To present products and services to you that we think may be of interest to you
  • Maintain, market and improve our loyalty program
  • For any other lawful purpose

 

How is the Personal Information We Collect Disclosed?
Your Personal Information may be disclosed as follows:

 

  • Franchisees: We may share your Personal Information with our franchisees, who individually own and operate Franchised Salons.

 

  • Affiliates: We may disclose your information to our affiliates, who may use your Personal Information as described in this Privacy Policy, including for their direct marketing purposes. (California residents have certain rights set forth below.)

 

  • Vendors and Service Providers: We may share your Personal Information with vendors and service providers with whom we, our affiliates, or our franchisees have a business relationship. For example, we may share your information with website hosting, marketing, email and texting delivery services and companies such as advertising agencies and marketing automation providers; accountants, legal advisors, and other vendors.

 

  • Merger or Acquisition: We may share your Personal Information with a third party who acquires any part of Dessange itself, or any of its affiliates, whether such acquisition is by way of merger, consolidation, or purchase of all or a substantial portion of our assets.

 

  • Disclosure Permitted by Law: We may share your Personal Information to government or public agencies, law enforcement authorities, regulators, and/or any other person or entity having legal authority or justification for receipt of your Personal Information if: (i) we believe that we are required to do so by law; (ii) we believe that we are permitted to do so by law or legal process; (iii) to respond to a claim; or (iv) to protect the rights, property, or safety of Dessange, its affiliates, its franchisees, or others.

 

Without limiting the above, we may share aggregated information that does not identify you or de-identified information about you with third parties, franchisees, or affiliates for any purpose, except as prohibited by law.

 

How Do We Protect Your Personal Information?
Dessange takes reasonable steps to help protect your Personal Information. However, data transmitted over the Internet is not completely secure, and we cannot guarantee the security of any information that is provided to us.

 

Other Information

 

  • Children’s Online Privacy: The Services are intended for general audiences and are not directed to children under thirteen years of age. Dessange does not knowingly collect personal information as defined by the U.S. Children’s Online Privacy Protection ACT (“COPPA”) from children in a manner that is not permitted by COPPA. If we become aware that a child under 13 has provided us with personal information as defined by COPPA, we will delete the child’s information from our records to the extent required by COPPA.

 

  • Your California Privacy Rights: We may share personal information as defined by California’s “Shine the Light” law with third parties and/or affiliates for such third parties’ and affiliates’ own direct marketing purposes. If you are a California customer, you are entitled to request certain information regarding our compliance with this law. To request such a notice, please send a written request to [email protected]. Requests must include “California Privacy Rights Request” in the description and include your name, street address, city, state and zip code.

 

  • Changes to this Privacy Policy: We may revise this Privacy Policy from time to time, and/or use your Personal Information for new, unanticipated uses not specified in this Privacy Policy. Should we update this Privacy Policy, updated versions of this Privacy Policy will be posted on the Website. You should review this Privacy Policy periodically, so that you can be up to date on our most recent privacy policy and procedures.

 

  • This Privacy Policy is governed by the internal substantive laws of Massachusetts, without regard to its conflict of laws principles. Jurisdiction for any claims arising under or out of this Privacy Policy shall lie exclusively with the state and federal courts within Massachusetts.
